Your inputs

Purchase or Refinance
A purchase needs an owner’s policy for the buyer and, if there is a loan, a lender’s policy. A refinance only needs a new lender’s policy, and there is no deed or deed tax.
Property location
Sets the Documentary Stamp rate on the deed and who customarily pays for the owner’s policy. Miami-Dade has its own deed-stamp rates and buyer-pays custom; Monroe County and the rest of Florida use the statewide $0.70 per $100 and, by custom, the seller usually pays.
Property type
In Miami-Dade, a single-family home pays $0.60 per $100 in deed stamps and everything else pays $1.05. Condominiums add the ALTA 4.1 endorsement and townhomes or HOA communities (planned unit developments) add ALTA 5.1 when there is a loan.
Purchase price
The owner’s policy covers the full price, so its premium and the deed stamps are figured on this amount.
Loan amount
The lender’s policy, mortgage stamps and intangible tax are figured on this amount. Enter 0 for a cash purchase.
Reissue rate and prior policy amount
If the property was insured by an owner’s policy issued less than three years ago (for a refinance, the existing loan policy), Florida’s lower reissue rate applies up to the prior policy’s amount. Any amount above it is charged at the regular rate. We confirm eligibility from the prior policy.

Title insurance

Owner’s title insurance policy
Protects the buyer’s ownership for as long as they own the property against covered title problems such as forged documents, unknown heirs or recording errors. A one-time premium set by the State of Florida: $5.75 per $1,000 for the first $100,000, $5.00 per $1,000 up to $1 million, then $2.50, $2.25 and $2.00 per $1,000 in higher tiers, with a $100 minimum.
Lender’s policy (simultaneous issue)
Protects the lender’s mortgage. Issued at the same closing as the owner’s policy, it costs a flat $25 for coverage up to the purchase price; any loan amount above the price is charged at the regular rate. On a refinance it is priced at the full rate on the loan amount.

Lender endorsements

Florida Form 9
Extends the lender’s coverage to restrictions, encroachments and certain survey and mineral-rights matters. Required by nearly every lender. Charged at 10% of the policy premium (owner’s plus lender’s on a purchase), with a $25 minimum.
ALTA 8.1 environmental protection lien
Covers the lender if a recorded environmental lien takes priority over the mortgage. $25.
ALTA 4.1 condominium
Covers condominium-specific risks such as unpaid assessments that take priority and violations of the declaration. $25, condominiums only.
ALTA 5.1 planned unit development
The same protection for townhomes and HOA communities governed by a declaration. $25.

State taxes and recording

Documentary Stamps on the deed
Florida’s transfer tax, charged per $100 of the price (rounded up). In Miami-Dade, $0.60 for a single-family home and $1.05 for other property; elsewhere $0.70. The seller customarily pays.
Documentary Stamps on the mortgage
$0.35 per $100 of the new loan (rounded up), paid by the buyer or borrower.
Intangible tax on the mortgage
A one-time Florida tax of 0.2% ($2 per $1,000) of the new loan, paid by the buyer or borrower.
Recording fees (estimate)
The county Clerk charges $10 for the first page and $8.50 for each additional page. We assume a 3-page deed ($27) and a 20-page mortgage ($171.50); your actual documents may differ.

How It Works

How Florida title rates are set.

Florida is a promulgated-rate state: the Office of Insurance Regulation sets the premium for title insurance, so every title company charges the same premium for the same policy. The owner’s policy is priced on the purchase price, at $5.75 per $1,000 for the first $100,000 and $5.00 per $1,000 from $100,000 to $1 million, with lower rates above that.

When a lender’s policy is issued at the same closing, it costs $25 for coverage up to the purchase price. Lenders also require endorsements, usually Florida Form 9 at 10% of the premium and ALTA 8.1 at $25, plus a condominium or PUD endorsement where it applies.

The State of Florida also charges Documentary Stamp tax on the deed (in Miami-Dade, $0.60 per $100 for a single-family home and $1.05 per $100 for other property), $0.35 per $100 on a new mortgage, and a 0.2% intangible tax on the loan.

Are title insurance rates the same at every Florida title company?

Yes. Florida promulgates title insurance premiums, so the owner's and lender's policy premiums for the same transaction are the same at every title company. What differs are the title search, settlement and closing service fees, and the service you receive.

What is a simultaneous issue loan policy?

When the owner's and lender's policies are issued at the same closing, the lender's policy costs $25 as long as the loan amount does not exceed the purchase price. Any amount above the purchase price is charged at the regular rate.

When does the reissue rate apply?

If the property was insured by an owner's policy issued less than three years before the new policy, Florida's lower reissue rate applies up to the amount of that prior policy. Provide the prior policy so we can apply the credit.

Which endorsements do lenders usually require?

Most residential lenders require Florida Form 9 and ALTA 8.1 (environmental protection lien), plus ALTA 4.1 for a condominium or ALTA 5.1 for a planned unit development such as most townhomes and many gated communities.
